What is a utility model?

A utility model is any useful machine, implement, tools, product, composition, process, improvement or part of the same, which does not possess the quality of an invention, but which is of practical utility, novelty and newness.

What is the difference between a utility model and an invention?

A utility model is only a registration and it no longer undergoes substantive examination. An invention patent is entitled to twenty (20) years of protection from its filing date while a utility model is only entitled to seven (7) years from date of filing, with no possibility of renewal.

What are the requirements for filing a Utility Model application in the Philippines?

The requirements for filing a Utility Model application are as follows:

How long will the protection of a utility model valid?

A utility model registration shall expire, without any possibility of renewal, at the end of the seventh (7th) year after the date of filing of the application.

Can a registered utility model be cancelled?

Yes. The registration may be cancelled by the Director of Patents at the instance of any person who may be damaged by the registration if such is found lacking practical utility, newness and novelty.
